- Introduction
- These Terms of Use (“Terms”) govern your use of Hyperight’s websites, digital platforms, memberships, event registrations, content, services, and any related features.
- By registering, subscribing, accessing or using any Hyperight service or content, you confirm that you accept and agree to these Terms and all referenced policies (e.g., Privacy Policy, Community Guidelines).
- If you do not agree with any part of these Terms, you must not use Hyperight’s services or content.
- Definitions
- “Platform” means any website, subdomain, application, or digital service operated by Hyperight (e.g. hyperight.com, hyperightdatatalks.com, event pages).
- “Content” means all media, texts, articles, videos, recordings, presentations, surveys, downloads, and other materials made available through the Platform or events.
- “User” or “You” refers to any individual or legal entity accessing or using Hyperight services.
- “Free Membership” means a membership level on hyperight.com granting limited access to curated content and complimentary events, at Hyperight’s discretion.
- “Premium Membership” means a paid subscription on hyperight.com granting full access to content, recordings, and premium features or events.
- “Subscriber” means any User on hyperight.com who holds either a Free or Premium Membership.
- “Events” means online and in-person programs (conferences, webinars, workshops, meetups) organized by Hyperight.
- “Speaker / Contributor Content” means presentations, submissions, media, or materials provided by external speakers or contributors made available through hyperight.com.
- “Original Content” means content created, produced, or controlled wholly by Hyperight.
- Who We Are
- Hyperight is an event and media organization focused on data innovation, analytics, AI, and digital transformation.
- We deliver content, learning experiences, networking, and event offerings for professional audiences and organizations.
- Some content on our Platform may be hosted or embedded from third-party services (e.g. YouTube, Dropbox, Google). Those services remain subject to their own terms and policies, and Hyperight is not liable for their performance.
- Membership Types & Access
- Free Membership
- Free Members enjoy complimentary access to selected curated content and invitations to certain events.
- Hyperight may modify, limit or suspend Free Membership privileges at its discretion.
- If a Free Member registers for two (2) complimentary events and fails to attend both without canceling, Hyperight may suspend or terminate that Free Membership.
- Premium Membership
- Premium Membership grants comprehensive access to Hyperight’s content library, recordings, premium features, and exclusive events.
- Premium Membership is activated once payment is accepted by Hyperight.
- Premium Membership is strictly personal and non-transferable; sharing access is prohibited.
- Free Membership
- Account Use & Restrictions
- All membership accounts are personal and non-transferable.
- You may use your account from multiple devices, but you may not share login credentials or permit others to use your account.
- Hyperight reserves the right to suspend or terminate accounts found to be shared or misused.
- Event Participation
- All events are subject to Event Delegate Terms and Conditions
- Event registrations are personal and may not be transferred, unless Hyperight allows it in writing.
- Hyperight reserves the right to modify, reschedule, or cancel any event at its discretion.
- Presentations at events are recorded, live-streamed, and may be offered on-demand. By participating, speakers and attendees agree to such recording and distribution.
- Opinions, data, or claims made by speakers or contributors are their own; Hyperight does not endorse nor takes responsibility for their accuracy.
- Billing, Renewals & Refunds
- Premium Membership is billed annually and renews automatically unless cancelled in advance.
- You may cancel anytime through your account or by contacting Hyperight; access to Premium benefits ends immediately.
- If you contact Hyperight within 30 days of subscription start, you may request a refund (less non-recoverable transaction fees) at Hyperight’s discretion.
- Hyperight reserves the right to change subscription fees or billing terms with 30 days’ notice.
- In case of payment failure or delay, Hyperight may suspend your access, charge interest as per Swedish law, and apply collection fees.
- Intellectual Property & Licensing
- All Original Content is the exclusive property of Hyperight. Unauthorized reproduction, distribution, or use outside membership terms is prohibited.
- Speakers and contributors retain ownership of their work but grant Hyperight a non-exclusive, royalty-free, worldwide license to use, edit, publish, distribute, and display their submitted or recorded content, unless otherwise agreed in writing.
- The license does not allow users to circumvent access controls or resell content.
- Trademarks, logos, and branding on the Platform or in events belong to Hyperight or licensors and cannot be used without permission.
- Some content published or displayed on the Hyperight Platform may be partially or fully generated, edited, or enhanced using artificial intelligence (AI) technologies. This includes but is not limited to text summaries, articles, images, video captions, or sound design. While Hyperight takes reasonable steps to ensure accuracy and quality, such content may contain errors, omissions, or interpretations that differ from human-produced content. Hyperight disclaims any liability arising from reliance on AI-generated materials and does not guarantee their completeness or accuracy.
- User-Generated Content & Future Features
- If Hyperight enables comment, review, rating, or submission features, you grant Hyperight a license in line with Clause 8.2 for any content you submit.
- Hyperight may moderate or remove content that violates these Terms, laws, or internal policies.
- Survey answers or public contributions may be aggregated or anonymized and published; by submitting, you consent to such use.
- Advertising & Promotions
- Hyperight may display advertisements, sponsored content, or promotional banners.
- Any transaction arising from such promotions occurs outside Hyperight’s platform and is governed by the third-party’s terms.
- Hyperight is not liable for the fulfillment, quality, accuracy, or disputes from third-party offerings.
- Email, Marketing & Communications
- On registration you may receive necessary transactional emails and, if opted-in, marketing messages.
- Free and Premium users may receive different promotional communications, based on consent.
- Hyperight may send promotional emails featuring third-party events or offerings.
- You can unsubscribe or request to stop marketing emails via links in the emails or via your settings.
- Emails are sent via CRM or email services (e.g., HubSpot) under data processing agreements with proper safeguards.
- Data, Privacy & Cookies
- Your personal data is processed under the Hyperight Privacy Policy, which is separate from these Terms.
- Some Hyperight events may require additional, event-specific consents beyond the general policy.
- Hyperight uses cookies, pixels, and analytics tools (Google Analytics, HubSpot, Hotjar, Mixpanel) for performance, user experience, and usage analysis.
- A cookie banner is shown at first visit; continued use signifies consent to cookies, subject to your choices in the Cookie Policy.
- You must be at least 18 years old to register.
- You must register using a professional or company email address—personal email domains are disallowed.
- Hyperight will act as Data Controller under GDPR and other applicable data protection laws.
- Accessibility
- Hyperight is committed to improving accessibility across its Platform.
- We are working toward compliance with recognized accessibility standards (e.g. WCAG 2.1 AA), where technically and operationally feasible.
- Force Majeure
- Neither party is liable for failure or delay caused by events outside its reasonable control (e.g. natural disasters, pandemics, wars, service outages, third-party failure).
- In such cases, Hyperight may suspend its obligations without liability until the event is resolved.
- Dispute Resolution
- Any dispute under these Terms should first be addressed through good-faith negotiation.
- If no resolution is reached, either party may pursue legal action in accordance with Clause 16.
- Governing Law & Jurisdiction
- These Terms are governed by Swedish law.
- All disputes will be handled in the courts of Stockholm, Sweden, unless mandatory consumer laws dictate otherwise.
- Entire Agreement & Amendments
- These Terms, the Privacy Policy, Community Guidelines, and event-specific terms together form the full agreement between you and Hyperight.
- No waiver or modification is valid unless in writing and signed by both parties.
- Hyperight may update these Terms from time to time. Material changes will be notified via email or on the Platform; continuing use indicates acceptance.
